This case is a great example of how bad luck can catch up with violations that no one was ever expected to see. The OSHA inspectors were on their way to a different site when they passed the trench, saw debris from the roadbed being knocked in by passing vehicles and did not see anything to protect workers if a wall gave way without warning.
